Inquisitio Contra Haereticos. The Inquisition Trials of Witches, Heretics and Secret Societies
2022
By means of very rare manuscripts and precious historical sources (dating back even to the 16th century), this book aims to reconstruct the varied and complex phenomenon of the Inquisition, with particular scientific reference to the events that took place and unfolded in Sicily through the centuries. Based on primary ancient documents, it constitutes a monographic and reasoned catalogue of the international exhibition on the evolution of the Inquisition, curated in Palermo (Italy) by Francesco Callari and Antonio Scaglione. The exhibition, which was supported by an authoritative Scientific Board, was awarded important institutional recognitions and, in particular, the Medal of the Presiden…
EUIPO Boards of Appeal in the Light of the Principle of Fair Trial
2022
The EUIPO’s Boards of Appeal are called upon to decide on appeals against decisions by the bodies of ‘first instance’. However, their judicial function has always been denied. Conversely, the essay tends to place the Boards of Appeal of the EUIPO in any case within the concept of ‘court’, as defined by the ECtHR, within the framework of Article 6 ECtHR, because it assesses their independence, impartiality, and in general the guarantees required by the ‘fair trial’, until concluding that it is a paradigmatic model in the overall administration and judicial system. EUIPO Boards of Appeal, European Court of Human Rights, Court of Justice of the Eurpean Union, EU Charter of Fundamental Rights, …
Report on Italy
2019
The right to take part personally in criminal proceedings, although not expressly provided at a Constitutional level, is an expression of the principle of a fair trial upheld by Article 6 of the ECHR and translated into Article 111 of the Italian Constitution. In the course of years, the CCP, also following some condemnations by the Strasbourg Court, underwent several modifications aimed at implementing principles and conditions affirmed by the ECHR that can legitimate proceedings in absentia of a defendant. This study is structured into different parts. In the first, an analysis of national rules concerning the participation of a defendant and other private parties at each stage of proceed…
Fair Trial e "giusto processo" italiano
2016
2020
The “Judge of the laws” delivers to the Parliament punctuals directives to give concreteness to the reasonable duration of the trial. What is at stake is the right to renew the evidence in the event of a change of the judge, which is drastically reduced to prevent it from being used merely for dilatory purposes. The Author criticizes the decision in question, fearing a dangerous drift: the renewal only of the “useful” evidence.
Notificazioni al difensore dirette all'imputato
2022
The delegation law, intervening on the discipline of notifications, intends to consolidate the system of notifications by delivery to the defender. The analysis of the various guiding criteria will bring out a picture that seems to favor legal knowledge of the act, in clear contrast to the most recent arrests of jurisprudence.
The defendant’s guilt beyond a reasonable doubt in the Italian criminal justice system
2021
The criminal law standard of Beyond A Reasonable Doubt (BARD) constitutes an evidentiary and judicial rule, formulated and applied for centuries in common law jurisdictions, which was expressly stated in the Italian Code of Criminal Procedure only about fifteen years ago. Unfortunately, the concept of reasonable doubt is inherently complex and does not easily lend itself to definition or refinement. In this regard, the Author examines especially the various positions and elaborations developed by legal literature and case-law in Italy, proposing a specific interpretation of the BARD rule that enhances and completes the particular procedural connotations of the adversarial system adopted i…
Effetti “inibitori” della interdittiva antimafia e bilanciamento fra principi costituzionali: alcune questioni di legittimità dedotte in una recente …
2021
Moving from a very recent order of submission to the Italian Constitutional Court, the paper analyses some of the critical profiles that – in the last years – are related to the institute if the s.c. “interdittiva antimafia” (i.e. “anti-mafia interdictive), among the wider discipline provided against the organized crime. Regarding the parameters evoked by the Administrative Judge, it is intended to reflect on the delicate balancing procedure between rights and liberties that – equally guaranteed by the Constitution – inevitably collide as the aforementioned institute is enforced and that require, then, a particular care by the proceeding Public Administration: the private economic initiativ…
La regola di giudizio nel patteggiamento tra cursus ordinario e revisione
2022
The article aims to deepen a fundamental and much debated profile in relation to the special rite of the Italian patteggiamento. In particular, the Author, in the light of an analysis of the undoubted particularities of the judicial mechanism of application of penalty upon request of the parties, intends to focus on the essence and the operation that the judgment rule assumes, respectively, in the ordinary cursus of criminal proceeding and in therevision, trying to offer an interpretative reconstruction that is able to reconcile the (substantial) needs of justice and the (formal) reasons for systematic coherence.
